Terms of Service

Welcome to DGX Rush! These Terms of Service (“Terms”) govern your access to and use of our platform, including but not limited to CRM, Email, Phone, SMS, and Social Media marketing tools (collectively, the “Services”). By using our Services, you agree to these Terms.
1. Account Registration & Eligibility
You must be at least 18 years old and provide accurate account information to use our Services. You are responsible for maintaining the confidentiality of your login credentials.
2. Use of Services
You agree to use DGX Rush only for lawful business purposes and in compliance with all applicable laws, including:
Telecommunications rules for email, SMS, and phone outreach
A2P 10DLC compliance for SMS messaging in the U.S.
Anti-spam laws such as CAN-SPAM and TCPA
You may not use our Services for:
Sending unsolicited or unlawful communications
Transmitting prohibited content (e.g. S.H.A.F.T.: sex, hate, alcohol, firearms, tobacco)
Infringing on the intellectual property of others
3. SMS Messaging Program (A2P Compliance)
When using our SMS messaging features:
Consent is required: You must obtain explicit opt-in consent before sending messages.
No pre-checked boxes: Messaging consent must be obtained through an unselected checkbox, separate from terms agreement.
Frequency disclosure: You must disclose how often messages will be sent.
Fee disclosure: You must inform users that "Message and data rates may apply."
Opt-out compliance: All messages must include "Reply STOP to unsubscribe."
Help instructions: Include "Reply HELP for help or contact [email protected]."
4. Payment Terms
Use of the DGX Rush platform may require payment of subscription fees. Payment terms, renewal, and refund policies are detailed at checkout and within your account dashboard. All payments are non-refundable unless otherwise stated.
5. Cancellation & Termination
You may cancel your account at any time by contacting [email protected]. We reserve the right to suspend or terminate your account if you violate these Terms or engage in behavior that may harm the platform or other users.
6. Intellectual Property
All content and software on DGX Rush, including branding, text, images, code, and features, are the property of DGX Rush or its licensors. You may not copy, distribute, or create derivative works from any content without written permission.
7. Privacy Policy
Your use of our Services is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information.
8. Disclaimers and Limitation of Liability
DGX Rush provides services “as is” and makes no guarantees regarding uptime, effectiveness, or fitness for a particular purpose. Carriers are not liable for delayed or undelivered SMS messages. We are not liable for losses or damages resulting from service use.
9. Modifications to the Terms
We may update these Terms from time to time. Continued use of the Services after updates indicates acceptance. The latest version will always be available on our website.
10. Governing Law & Disputes
These Terms are governed by the laws of Tennessee and the United States. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration or in the courts of Tennessee.
